
What will be the religion of the child born to parents married under Special Marriage Act 1954?
I am a hindu girl in love with a muslim boy… planning to get married under Special Marriage Act 1954. I would like to know what religion should my children follow. Will there be any legal complications for the children. I would also like to know is there any possibilty that either of our parents can legally disown us.
I had previously too answered such question with regard to religion of the children born out of inter-religious marriage, the religion of the children is an open issue let it be decided by the children themselves when they grow up, or let both parents come to a compromise on this issue in the interest of their children, let not their peaceful matrimonial life be spoiled by such non-issue such as religion & bring disharmony in their life, after all this religion has brought so much of distress in the whole world for every one.
As far disowning by the parent’s of the parties to marriage, that is their own decision for which no one can say anything, whether they disown their children or not, this is entirely up to them, as rightly pointed out by the Apex Court just recently that in inter-religious marriage parents of both side have no right to object legally to such marriage if the parties to marriage are of marriageable age, what maximum they can do is to disown such children who indulge in inter-religious/inter-caste marriages, so let it be.
